About us
Mercho is a trading name of Rosefold Ltd, a company registered in England and Wales.
These terms apply to orders placed with Mercho. Our products are supplied for business use and our website is intended for business customers.
Orders
By placing an order with us, the customer is offering to purchase the goods in accordance with these terms.
An order is accepted when we confirm acceptance or begin fulfilling the order.
We may contact the customer after an order is placed to confirm artwork, specifications or any other details needed before production can begin.
Artwork & approval
For custom-made products, we'll provide artwork for approval before production.
It's the customer's responsibility to check the artwork carefully, including the design, wording, spelling, colours, dimensions and other details shown.
Production will only begin once the final artwork has been approved.
Once artwork has been approved and production has started, changes or cancellations may not be possible.
Product specifications
We'll make every reasonable effort to ensure the finished goods are materially consistent with the approved artwork and agreed specification.
Some manufacturing and printing processes naturally involve small variations in colour, positioning, dimensions, materials or finish. Reasonable variations of this kind will not normally be considered defects.
Product photographs, illustrations and digital artwork on our website are intended to give a fair representation of our products, but screens, photography and manufacturing processes can result in differences in appearance.
Prices & payment
Unless stated otherwise, prices shown on our website are exclusive of VAT, which will be added at the applicable rate.
Any quotation is based on the quantities, specification and other requirements stated in it.
Payment must be made in accordance with the terms agreed for the order. Where payment is required at checkout, the order will not proceed until payment has been successfully received.
Delivery
Any delivery date or lead time we provide is our best estimate based on the information available at the time.
We'll always do our best to meet agreed timescales, but manufacturing and delivery can occasionally be affected by circumstances outside our reasonable control.
If we become aware of a significant delay, we'll let the customer know as soon as reasonably possible.
Problems with an order
We want every order to arrive exactly as expected.
If goods arrive damaged, defective, materially different from the approved artwork or agreed specification, or otherwise not of the standard reasonably expected, please contact us at info@mercho.co.uk as soon as possible.
We'll review the issue and work with the customer to put it right. Depending on the circumstances, this may include replacing the affected goods or agreeing an appropriate partial or full refund.
Cancellations
Because our products are made specifically for each customer, an order cannot normally be cancelled due to a change of mind once production has started.
If production hasn't started, please contact us as soon as possible. Where we're able to cancel the order, any costs already incurred specifically for that order may be deducted from any refund where appropriate.
Customer-supplied content
The customer is responsible for ensuring that any logos, trademarks, designs, wording or other material supplied or requested for use on an order can lawfully be used for that purpose.
By asking us to reproduce such material, the customer confirms that they have the necessary permission or authority to do so.
Liability
Nothing in these terms excludes or limits any liability which cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.
Subject to the above, to the fullest extent permitted by law, Rosefold Ltd will not be liable for any indirect or consequential loss, loss of profit, loss of business, loss of revenue, loss of anticipated savings or loss of goodwill arising from an order.
Our total liability arising out of or in connection with an order will not exceed the total amount paid or payable to us for that order.
Events outside our control
We won't be responsible for a failure or delay in performing our obligations where this results from circumstances outside our reasonable control.
This may include events such as transport disruption, industrial action, natural disasters, acts of government, import or export restrictions, disruption to utilities or communications, or significant disruption affecting manufacturing or supply chains.
We'll always make reasonable efforts to minimise the impact of any such event and keep affected customers informed.
Intellectual property
All intellectual property belonging to Mercho or Rosefold Ltd, including our website content, branding, graphics and original designs, remains our property unless otherwise agreed in writing.
Customer-owned logos, trademarks and other customer-supplied material remain the property of their respective owners.
Privacy
Personal information is handled in accordance with our Privacy Policy.
Changes to these terms
We may update these terms from time to time. The terms applying to an order will be those in force when the order is placed, unless otherwise agreed in writing.
Governing law
These terms and any dispute or claim arising from them or an order are governed by the laws of England and Wales.
The courts of England and Wales will have jurisdiction over any dispute or claim arising in connection with them.
